1. Introduction
This platform is operated by Clam.AI Venture Pvt. Ltd. ("HobbyFi," "we," "our," or "us"). We provide hobby booking services ("Core Services") and community features ("Social Features"), collectively referred to as "Services" through our website (www.hobbyfi.in), vendor portal (partner.hobbyfi.in), and mobile applications (collectively, the "Platform").
This document ("Terms") establishes a legally binding agreement between you and HobbyFi. By registering an account or using our Platform, you accept these Terms in their entirety. If you disagree with any portion, please refrain from using our Platform or Services.
This electronic record complies with applicable information technology laws and does not require physical or digital signatures.
Your acceptance of these Terms includes acceptance of our Privacy Policy. You also consent to receive promotional communications from HobbyFi, which you may opt out of at any time.
2. Key Definitions
- Account: Your registered profile on our Platform.
- Booking Fee: The amount charged for reserving a hobby session.
- Convenience Fee: Fee charged by HobbyFi for use of our technology platform.
- Cancellation Fee: Charges applicable when canceling a booking.
- HobbyFi Pass: A digital or physical pass that grants access to specific activities.
- Total Fee: The combined sum of all applicable charges for a booking.
- Venue Membership: A plan purchased through our Platform for access to specific venue facilities.
3. Eligibility
You must be legally competent to enter into binding contracts under applicable laws to use our Services.
If your jurisdiction restricts platform usage based on age, your legal guardian will be bound by these Terms through your use.
4. Account Registration
4.1 Account Creation
To access certain features, you must register an account by providing accurate personal information as requested.
4.2 Account Responsibility
- You are responsible for maintaining the confidentiality of your account credentials
- All activities occurring under your account are your responsibility
- You must notify us immediately of any unauthorized account use
- We may suspend accounts if we suspect false information or security compromise
- Only one account per person is permitted
5. Service Usage
When using our Platform, you agree to:
- Use the Services only for personal, non-commercial purposes
- Provide accurate information when booking activities
- Comply with all applicable laws and regulations
- Not attempt to harm our Platform or networks
- Not create unauthorized accounts
- Not violate others' rights or engage in illegal activities
- Not use our Platform for sending unsolicited messages
- Maintain device and account security
- Follow venue-specific rules when participating in activities
HobbyFi reserves the right to terminate services for non-compliance with these Terms.
5.1 Special Features
- HobbyFi Pass: Grants access to specific activities subject to availability on a first-come, first-served basis.
- Venue Memberships: Subject to the specific terms outlined when purchasing.
- Community Features: Allow users to create and join activity groups.
HobbyFi may modify any feature terms with prior notification to users.
6. Booking Confirmation
Upon receiving your booking request, we will confirm or decline based on availability. You are responsible for checking confirmation details and notifying us immediately of any errors.
7. Payments
7.1 Fee Structure
- HobbyFi charges a Total Fee for each booking
- Additional charges may apply based on activity specifics
- All applicable taxes will be borne by you
7.2 Payment Methods
You may pay using:
- Credit/debit cards
- Digital wallets
- Net banking
- Cash (where applicable at venue)
8. Cancellation and Refund Policy
8.1 Vendor Cancellation Policies
HobbyFi does not set cancellation policies for third-party vendors. Each venue/activity provider establishes their own policy, which will be clearly displayed during booking.
8.2 Cancellation Types
Vendors choose one of the following cancellation policies:
- Type A: 100% refund for any cancellation.
- Type B:
- 100% refund if cancelled before 24 hrs
- 75% refund before 12 hrs
- 50% refund before 3 hrs
- Type C:
- 100% refund before 24 hrs
- 75% before 12 hrs
- 50% before 6 hrs
- 25% before 3 hrs
8.3 HobbyFi-Organized Events
For events organized directly by HobbyFi:
- All fees are non-refundable, non-transferable, and non-exchangeable
- If we cancel an event, you'll receive a refund in 7 days
8.4 Refund Processing
Refund processing may take 7-10 working days and may be subject to payment gateway charges.
9. Customer Support
For questions, concerns, or complaints, contact our Customer Support at support@hobbyfi.in.
Issues must be reported within 7 days of occurrence for guaranteed assistance. We will endeavor to respond within 7 working days.
10. Force Majeure
HobbyFi shall not be liable for any failure to perform obligations if performance is prevented by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, or technical failures.
11. Indemnification
You agree to defend, indemnify, and hold harmless HobbyFi, its affiliates, partners, and employees from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your misuse of the Platform
- Your infringement of third-party rights
- Content you provide to our Platform
12. Limitation of Liability
12.1 General Limitations
To the maximum extent permitted by law, HobbyFi shall not be liable for:
- Any indirect, incidental, or consequential damages
- Loss of data, profits, or opportunity
- Service interruptions or technical issues
- Actions of third-party vendors or other users
- Damages resulting from your use of or inability to use our Services
12.2 Inherent Risks
You acknowledge that physical activities have inherent risks. By using our Services, you voluntarily assume all such risks. HobbyFi and its partners disclaim liability for injuries or damages occurring during activities.
12.3 Liability Cap
In no event shall our total liability exceed the amount you paid for the specific booking in question.
13. Intellectual Property
13.1 Ownership
HobbyFi owns all rights to:
- The Platform and Services
- All related logos, trademarks, and content
- Photos and videos taken during events
13.2 Limited License
We grant you a limited, non-exclusive, revocable license to use our Platform for personal, non-commercial purposes.
13.3 Restrictions
You may not:
- Modify or create derivative works of our Platform
- Reverse engineer our software
- Remove proprietary notices
- Use our intellectual property without permission
14. User Content
14.1 Content Ownership
You retain ownership of content you post, but grant HobbyFi a worldwide, royalty-free license to use, reproduce, and display such content.
14.2 Content Guidelines
When posting content, you must not:
- Share illegal, obscene, or defamatory material
- Violate intellectual property rights
- Share misleading information
- Harass or threaten others
- Upload malicious software
14.3 Event Photography
HobbyFi may capture photos or videos during events, which may be displayed on our Platform or social media. By participating in activities, you consent to such content creation and usage.
15. Term and Termination
15.1 Duration
This agreement remains in effect until terminated by either party.
15.2 Termination by You
You may terminate by deleting your account through the Platform.
15.3 Termination by HobbyFi
We may terminate or suspend your account with immediate effect if:
- You violate these Terms
- You misuse our Platform
- You engage in unethical or harmful behavior
15.4 Effect of Termination
Upon termination, your right to use the Platform ceases immediately. Provisions intended to survive termination will continue in effect.
16. Changes to Terms
HobbyFi reserves the right to modify these Terms at any time. Changes become effective upon posting to the Platform. Your continued use after changes indicates acceptance of the modified Terms.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Disputes shall first be resolved through amicable negotiation. If unresolved after 30 days, disputes will be settled through binding arbitration in Jaipur, Rajasthan, in accordance with the Arbitration and Conciliation Act, 1996.
